1. PARTIES

This Distance Sales Agreement ("Agreement") has been concluded electronically between the parties whose information is provided below, in accordance with the provisions of the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.

By approving this Agreement electronically, the BUYER acknowledges, declares, and undertakes that if the order is approved, they will be obliged to pay the product price, shipping fee, and any other additional fees.

2. DEFINITIONS

In the application and interpretation of this Agreement;

  • MINISTER: Refers to the Minister of Trade of the Republic of Turkey,
  • MINISTRY: Refers to the Ministry of Trade of the Republic of Turkey,
  • LAW: Refers to the Law No. 6502 on Consumer Protection,
  • REGULATION: Refers to the Regulation on Distance Contracts,
  • SELLER: Refers to the legal entity that offers goods to the consumer within its commercial or professional activities,
  • BUYER: Refers to the real or legal person who acquires goods for non-commercial or non-professional purposes,
  • SITE: Refers to the internet website with the domain name https://www.nihan.com.tr,
  • AGREEMENT: Refers to this Distance Sales Agreement,
  • GOODS: Refers to movable goods that are subject to purchase.

3. SUBJECT OF THE AGREEMENT

This Agreement regulates the rights and obligations of the parties regarding the sale and delivery of the product/products, whose characteristics and sales price are specified on the SITE, which the BUYER has ordered electronically via the SELLER's website https://www.nihan.com.tr.

The prices listed on the SITE are sales prices including taxes, unless otherwise explicitly stated. Campaigns and discounts are valid for the announced period.

4. SELLER INFORMATION

The SELLER's information is stated in Article 1 of this Agreement and is also available on the SITE in the "About Us / Contact / Legal Information" sections.

It is possible for the ordering party and the BUYER to be different individuals; in this case, the BUYER holds the status and rights of the consumer.

7. PRODUCTS SUBJECT TO THE AGREEMENT

The type, category, quantity, color, main characteristics, and sales price including VAT of the products are provided on the product page and in the order summary presented to the BUYER during the order process.

8. INVOICE

The invoice can be issued electronically or sent with the product, according to the BUYER's request.

9. GENERAL PROVISIONS

The BUYER accepts that they have been informed about the product, price, payment, delivery, withdrawal, and return conditions within the scope of the Preliminary Information Form and this Agreement before placing the order.

Products are delivered within the legal period of 30 days at the latest. In cases of force majeure, the BUYER is informed, and the collected amount is refunded.

10. DELIVERY AND SHIPPING

Delivery is made via HepsiJet Kargo, which is the SELLER's contracted courier company.

  • For orders of 3,000 TL and above, the shipping fee is covered by the SELLER.
  • For orders below 3,000 TL, the shipping fee is 79.90 TL.

The risk of loss and damage that may occur until the product is delivered to the BUYER belongs to the SELLER. The BUYER is obliged to check the package upon delivery.

11. RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract without giving any reason within 14 days from the date of receiving the product.

Returned products must be complete and undamaged. Return shipments must be made via Yurtiçi Kargo. The cargo must be delivered to Nihan Giyim Ankara with the customer code "274967225". The return shipping fee is covered by the SELLER.

12. CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for the following products:

  • Products manufactured specifically for the individual
  • Underwear and hygiene products
  • Products with opened packaging that cannot be resold
  • Digital content

13. DEFAULT

Payment transactions are between the BUYER and the bank, and the SELLER is not responsible for any consequences arising from default.

14. DISPUTES

Consumer Arbitration Committees and Consumer Courts are authorized in disputes.

15. EFFECTIVENESS

The BUYER is deemed to have accepted this Agreement when confirming the order. The Agreement becomes effective on the date it is approved electronically.
